I think it would've made a little more sense to keep 3.1 "untainted" from post-Commodore efforts and call this line 3.2 as it looks like more careful and deliberate work than the massive and IMHO kinda controversial overhaul that 3.5 and 3.9 were. They are using some lessons learnt from these and AmigaOS 4 though. They couldn't use code from these even if they had wanted to. So this doesn't relate to 3.5 or 3.9 at all. The source code for Amiga OS 3.5 and 3.9 has been lost because the plebs working on it weren't using a proper source control system or whatever, so Hyperion only have the compiled binaries like everyone else do, and that's not usable to build upon.
